According to Maître Marie-Yvonne Benjamin, this is a “major fault”. "This gigantic underestimation reveals a fault of the State," she insisted. "This fault is fraud, hence a claim for compensation," said the lawyer who estimated 71 million shortfall for COM.
The public rapporteur estimated him at some 30 million shortfall, part of the sums due being prescribed. He thus asked the administrative court to order the State to pay the COM of Saint-Martin the sum of 30 million.
