The government wants to include in law certain measures taken by derogation in Saint-Martin. The public is invited to submit their proposals.
While desired fast and "sustainable", the reconstruction of Saint-Martin after the passage of Irma is slow and complicated. It revealed a number of mainly administrative difficulties and constraints, which hampered reconstruction projects and the resumption of activities. It also exposed flaws in the legislative system. The government therefore wants to make regulations more effective in the event of natural disasters and "increase the resilience of the territories" Overseas. It is thus preparing a bill on major natural risks in the Overseas Territories.
It is a question of registering a large part of the measures which were taken by derogation by the State after Irma in Saint-Martin, such as resorting to partial activity for one year instead of six months, the development dismissal procedures.
The government also wants to increase the penetration rate of insurance overseas by adapting the offer and making the products more accessible. This is the subject of a mission entrusted to the finance inspectorate and the general council for sustainable development. The mission must also identify the factors of non-insurance overseas. The government would also like to guarantee the use of reconstruction allowances; indeed, it was found that part of it was not used for this purpose after Irma in Saint-Martin.
Following the difficulties encountered within certain co-ownerships to validate the reconstruction work (absence of co-owners), the government suggests for example a specific device allowing to impose the convocation of a general assembly in a short time and to lower the only of majority required to vote the reconstruction of the residence.
In total, the bill includes eight major measures: the establishment of prevention days, the adaptation of the insurance offer and compensation methods, the promotion and integration of seismic and paracyclonic measures, the creation of 'a procedure establishing a' state of exceptional natural calamity, the establishment of an obligation for operators to provide technical equipment and skills to restore networks to a minimum, the obligation to restore a condominium after a hazard major, the adaptation of labor law in the event of an exceptional event and the exemption from dock dues in the event of a hazard due to certain equipment.
