Following fraud to obtain residence permits in 2019, the prefecture asked the border police to conduct judicial investigations, specifically in cases of request for political asylum. This is how the name of MBB, a national of the Dominican Republic naturalized French in 2012 and aged 61, was highlighted.
MBB gave his address to Venezuelans to obtain political asylum in France. "I helped them as I was helped when I arrived on the island", he justifies himself to the local court before which he appeared last week for having notably established inaccurate attestations between the 1st August 2019 and June 29, 2020.
The border police investigation also revealed that MBB issued a false residence certificate to a Dominican compatriot. CPG, 47, has recently moved to the Dutch side. She holds a Sint Maarten residence permit just like the father of her son. However, she wanted to educate her child in part French. She therefore asked MBB to provide her with a certificate of residence on the French side. What he did. CPG is also being sued for forgery and fraudulent obtaining of an administrative document.
“MBB is part of a network and he is taking advantage of the situation,” comments the prosecutor. "He knowingly violated the rules," he continues before requesting a four-month suspended prison sentence and a fine of 1 euros. Against CPG, the prosecution requested a 500 euros fine, half of which was accompanied by a suspension and a ban on stay in France for five years.
After deliberation, the court sentenced MBB to a three-month prison term and a fine of 2 euros and CPG to 000 euros, including 800 euros with a suspended sentence as well as a stay ban in France for two years. They must also pay a symbolic euro to the prefecture.
Finally, the Venezuelans who had used MBB's address to seek asylum, had their request refused by the prefecture.
